Deep Sea Fishing Cape Town does not operate the charter and does not set a single cancellation or refund schedule for independent Charter Operators. The selected operator’s written cancellation policy applies to the actual charter.

1. Our role

Southern Africa Experiences CC, operating www.deep-sea-fishing.co.za, provides an enquiry, introduction and booking-facilitation service. The actual charter is provided by the independent Charter Operator selected by the customer.

Because independent Charter Operators may have different vessels, costs, cancellation windows, weather rules and refund terms, there is no single Deep Sea Fishing cancellation percentage that applies to all charters.

2. Which cancellation policy applies

Before confirming and paying for a charter, the customer should receive or be given access to the selected Charter Operator’s cancellation, rescheduling, refund, no-show and weather policy. That operator policy forms part of the customer’s charter contract and controls cancellation or refund rights for the actual charter, subject to applicable South African consumer law.

Deep Sea Fishing cannot amend, waive or override an operator’s cancellation terms unless the operator gives written authority to do so.

3. Booking confirmation and payment

An enquiry or provisional availability check is not a confirmed booking. Unless the selected Charter Operator agrees otherwise in writing, full upfront payment is required to confirm a charter and the Charter Operator must provide written booking confirmation or written acceptance.

Payments for the charter should be made in accordance with the selected Charter Operator’s instructions. The Charter Operator is responsible for receipts, refunds, credits, payment disputes and chargebacks relating to the charter.

4. Customer cancellations and rescheduling

If a customer wishes to cancel or move a confirmed charter, the request must be made directly to the selected Charter Operator, preferably in writing, as soon as possible. The operator’s notice periods, cancellation fees, rescheduling conditions and any credit or refund entitlement apply.

Deep Sea Fishing may assist by forwarding contact details or communications, but does not decide whether a refund, credit or rescheduled date is due and does not fund an operator’s refund.

5. Weather and sea-condition cancellations

The selected Charter Operator and its skipper are responsible for assessing the vessel, weather, wind, swell, visibility, passenger load and operating conditions. The skipper has final operational authority to decide whether a trip proceeds, is delayed, moved, altered, shortened, postponed or cancelled.

The operator’s written weather policy determines whether a customer is offered a reschedule, credit, refund or other remedy, subject to applicable law. Deep Sea Fishing cannot override the skipper or operator on weather or safety decisions.

6. Late arrival, missed departure and no-show

Customers must arrive at the operator’s stated meeting point by the required check-in time. Customers should allow sufficient time for traffic, parking, harbour access, fishing-licence checks, safety briefings and boarding.

Vessels cannot necessarily be held for late guests. A late customer may lose part of the booked charter time, the trip may be shortened by the amount of delay, or the Charter Operator may depart without the customer if waiting is not operationally possible.

Missing the vessel, arriving at the wrong meeting point, arriving after the operator’s cutoff, failing to bring required documents or permits, or failing to attend without adequate notice may be treated as a no-show under the Charter Operator’s terms. Such circumstances do not automatically create a right to a refund or replacement charter.

Deep Sea Fishing is not responsible for transport delays, parking delays, missed departures or shortened charter time caused by customer lateness.

7. Changes to the booking may require re-pricing or a new booking

Changing the charter date, type, duration, departure location, route, number of guests or vessel requirements may require a new quotation or a new booking. A larger group may require a different or additional vessel, and any add-ons or extra services are chargeable unless expressly included.

A reduction in guest numbers does not automatically reduce an accepted or confirmed charter price. Any reduction, credit or revised price requires the selected Charter Operator’s written approval and remains subject to applicable law.

8. Price changes before confirmation

Website and indicative charter prices may change without notice before final operator confirmation. This may result from fuel-price movements, exchange-rate movements, seasonal rates, vessel availability, operator pricing, guest numbers, location, charter type, duration or requested extras.

The Charter Operator’s final written quote or booking confirmation sets the price for the actual charter. After confirmation, any price variation is governed by the operator’s terms and any written agreement with the customer.

9. Mechanical, operational or vessel changes

If the Charter Operator experiences a mechanical, crew, vessel or other operational issue, any substitution, rescheduling, credit or refund is a matter between the customer and that Charter Operator. A vessel may also be changed where required by safety, weather, passenger capacity, charter type or operating conditions.

10. Seasickness, personal discomfort and customer-requested early return

Seasickness and physical discomfort are foreseeable risks of marine activities. If a customer asks the skipper to return early for personal reasons, any refund or credit consequence is governed by the selected Charter Operator’s written terms. Deep Sea Fishing does not authorise refunds or credits for an early return.

11. Fishing results

No catch or wildlife sighting is guaranteed. A poor catch, no catch or failure to encounter a particular species does not by itself create a right to a refund or reduction, subject to applicable law and the operator’s terms.

12. Refunds, disputes and chargebacks

All refund requests, cancellation disputes, payment disputes, chargebacks and claims relating to the actual charter must be taken up directly with the Charter Operator that accepted the booking and payment.

Deep Sea Fishing is not the decision-maker for operator refunds and cannot promise or compel a refund on an operator’s behalf. Where Deep Sea Fishing has merely introduced the customer to the operator, any financial dispute about the charter remains between those parties, subject to applicable law.

13. International and Cross-Border Charters

Deep Sea Fishing Cape Town may introduce customers to independent Charter Operators located outside South Africa, including Mauritius.

The cancellation, postponement, rescheduling, credit and refund conditions applicable to an international charter are determined by the selected Charter Operator and form part of the agreement between the customer and that Operator.

Deep Sea Fishing Cape Town does not impose a universal cancellation or refund policy on independent Charter Operators in different jurisdictions.

Where a charter in Mauritius or another country is cancelled, changed or disputed, the customer must deal directly with the selected Charter Operator in accordance with that Operator’s written booking conditions and any applicable local consumer or contractual law.

Currency movements or differences between the currency originally displayed for information purposes and the currency in which the Charter Operator invoices or refunds a customer may result in exchange-rate differences. Deep Sea Fishing Cape Town is not responsible for exchange-rate losses, bank charges or payment-provider conversion charges relating to payments or refunds made by an independent Charter Operator.

14. Travel and cancellation insurance

Customers are strongly encouraged to arrange suitable travel, cancellation and curtailment insurance. A weather cancellation, illness, missed flight, transport problem, late arrival or other event may cause additional travel or accommodation costs that are not recoverable from Deep Sea Fishing.
