2. No Guarantee of Catch
Deep sea fishing is a nature-based activity. We make no representation, guarantee, or warranty that any specific species, quantity, or size of fish will be caught during any charter. The success of a fishing trip is dependent on ocean conditions, seasonal migration, weather, tidal patterns, and factors entirely beyond our control. Clients book on the basis that fishing results cannot be guaranteed.
3. Weather and Sea Conditions
The ocean off Cape Point and Hout Bay is subject to rapidly changing and sometimes severe weather and sea conditions. We reserve the right, through the skipper as master of the vessel, to cancel, delay, or curtail any trip at any time where conditions are deemed unsafe or unsuitable. Such decisions are final. We accept no liability for any loss, inconvenience, or disappointment arising from weather-related cancellations or curtailments.
4. Seasickness and Physical Discomfort
Deep sea fishing involves extended periods at sea, often in open ocean swells. Seasickness, physical discomfort, and fatigue are foreseeable and normal occurrences. We accept no liability for seasickness, nausea, or any physical discomfort experienced by passengers during a charter. Clients are advised to take appropriate precautions including over-the-counter seasickness medication prior to departure.
5. Personal Property
Hooked on Africa Fishing Charters accepts no responsibility for the loss, theft, or damage of any personal property, equipment, cameras, clothing, personal fishing tackle, or other items brought aboard any vessel. All personal items are brought aboard at the client’s own risk.
6. Assumption of Risk
Deep sea fishing involves inherent risks including but not limited to heavy seas, physical exertion, handling of fishing hooks and tackle, proximity to marine wildlife, and ocean hazards. By participating in any charter, clients voluntarily assume all such inherent risks. A separate indemnity form will be required to be signed prior to boarding.
