This Manual is published in compliance with Section 51 of the Promotion of Access to Information Act 2 of 2000 (PAIA). It explains how members of the public may request access to records held by Hooked on Africa Fishing Charters. This Manual is distinct from our Privacy Policy, which governs the processing of personal information under POPIA.

2. Information Officer

The Information Officer has been duly registered with the Information Regulator of South Africa in accordance with Section 55A of PAIA (as amended by POPIA).

3. Purpose and Scope of This Manual

The South African Constitution (Section 32) guarantees the right of access to information held by public and private bodies where such access is required for the exercise or protection of rights. This Manual describes the categories of records held by us, the process for submitting a request, and the applicable fees.

4. Categories of Records Held

The following categories of records are held by Hooked on Africa Fishing Charters:

4.1 Client and Booking Records

  • Booking confirmations and correspondence
  • Client contact details and communication records
  • Payment records and invoices
  • Signed indemnity forms
  • Refund and cancellation records

4.2 Vessel and Operational Records

  • SAMSA vessel licences and Certificates of Fitness / Local General Safety Certificates
  • Skipper Certificates of Competence
  • STCW crew qualifications
  • Maintenance and safety inspection records
  • Trip logs

4.3 Financial and Corporate Records

  • Financial statements and accounting records
  • Bank records
  • Tax records and SARS correspondence
  • VAT records (if applicable)
  • Company registration documents

4.4 Employee and Contractor Records

  • Employment contracts
  • Crew records and qualifications
  • Payroll records

4.5 Regulatory and Compliance Records

  • DFFE fishing permits and correspondence
  • SAMSA licences and correspondence
  • Insurance policies and certificates
  • Business licences

4.6 General Correspondence

  • External correspondence with suppliers, partners, and authorities

5. How to Request Access to Records

5.1 A requester must submit a request using Form C as prescribed under PAIA (available from the Information Regulator or from us on request).

5.2 The completed Form C must be submitted to the Information Officer by:

5.3 The request must describe the record requested with sufficient particularity to enable us to identify it.

5.4 The request must state the form in which access is required (e.g. copy, inspection).

5.5 Where the request relates to a third party’s personal information, we will notify that third party and allow them an opportunity to respond before deciding on the request.

6. Prescribed Fees

6.1 A request fee of R50.00 is payable upon submission of the request (non-refundable).

6.2 Access fees may be charged for reproduction of records at the prescribed rates under the PAIA Regulations. Current prescribed fees are available from the Information Regulator’s website at www.inforegulator.org.za.

6.3 Where the requester is a personal requester seeking access to their own personal information, the request fee is waived and reproduction fees may be reduced at our discretion.

7. Timeframes for Response

7.1 We will respond to a request for access to records within 30 days of receipt of a properly completed Form C and payment of the request fee.

7.2 This period may be extended by a further 30 days in exceptional circumstances in terms of Section 57 of PAIA.

8. Grounds for Refusal

We may refuse access to records on grounds permitted under PAIA, including but not limited to:

  • Protection of third-party personal information
  • Commercial confidentiality
  • Legal professional privilege
  • Records subject to ongoing litigation
  • Safety and security considerations

Where access is refused, we will provide written reasons and inform the requester of their right to appeal or apply to court for relief.

9. Rights of Appeal and Remedies

9.1 Where a request is refused, the requester may:

  • Apply to the Information Regulator for a decision (in terms of Section 77A of PAIA, as amended)
  • Apply to the High Court for relief in terms of Section 78 of PAIA

10. Availability of This Manual

This Manual is available free of charge on our Website at www.deep-sea-fishing.co.za and is available in printed form on request from our Information Officer. A copy has been lodged with the South African Human Rights Commission as required by PAIA.
